BETWEEN
THE SCHOOL DISTRICT OF THE CITY OF ERIE (“DISTRICT”)
and
ERIE EDUCATION ASSOCIATION (“ASSOCIATION”)
RE: Priority Status of East Middle School WHEREAS, the District and the Association are parties to a Collective Bargaining Agreement effective July 1, 2022 through June 30, 2028 (“CBA”); WHEREAS, the filling of vacancies is addressed generally in the CBA; WHEREAS, within the past two years, East Middle School have been designated as Additional Targeted Support & Improvement (ATSI) schools by the state, meaning that performance by one or more student groups in the school is at or below schools facing significant challenges in academic achievement, student growth, and other areas; WHEREAS, the parties recognize an emergent need to fill vacancies at East Middle School and to address recurrent concerns within the building; and WHEREAS, the parties have agreed to certain incentives to attract and retain professional employees to East to fill the current vacancies. NOW, THEREFORE, in consideration of the mutual promises and obligations contained herein, the parties agree as follows:
1.Effective with the 2025-2026 school year, all positions existing and/or arising at East shall be filled in the following manner:
(a)The District will meet with incumbent professional employees holding permanent positions in East to explain the District’s plan and the requirements of this Agreement. As a condition of remaining in their current position, incumbent staff must be willing to commit to remain at East for three (3) school years, except as provided in Paragraph 2 of this Agreement.
(b)The District will meet with incumbent temporary professional employee to explain the District’s plan and the requirements of this Agreement and to assess their suitability for remaining in their current position. As a condition of remaining in their current position, incumbent staff must be willing to commit to remain at East for three (3) school years, except as provided in Paragraph 2 of this Agreement. Incumbent temporary professional employees will remain at East only by mutual agreement of the employee and the District.
(c)East employees will have the opportunity to bid on open positions if they are not interested in remaining in their current position under the conditions of this Agreement. If they are not successful in bidding into an alternative position they will be transferred to a position according to certification. Once an employee bids or is transferred out of East, they shall have no ownership or automatic right to return to their former position upon expiration of this Agreement. No employee will be furloughed based solely on their wish to opt-out of the provisions of this Agreement. In the unlikely event that no other position exists within the District to which such employees may be transferred, the employee may remain in a position at East but will not be eligible for compensation under this Agreement.
(d)Thereafter, all vacancies at East Middle School shall be posted separate from the District’s regular bid process in order to solicit the interest of temporary professional and professional employees in permanent appointment to the vacancies at East. The District will select candidates for consideration based on qualifications and mutual agreement of the District and the individual.
(e)In order to be awarded a vacant position at East, all interested employees must be willing to commit to remain at East until expiration of this Agreement, except as provided in Paragraph 2 of this Agreement.
(f)The awarding of vacancies at East or District and the interested employee.
2.Employees who accept positions at East under this Agreement must commit to remaining at East for three (3) school years except in the case of retirement, illness, furloughs, consequences of bumping, or resignation. Once a commitment is made, no bids or transfers out of the building will be permitted during the three (3) year period without District permission, except in cases where the employee is rated unsatisfactory.
3.Staff employed at East must commit to attending all professional development programming offered on Act 80 / Professional Learning days. Because of the importance of this programming, any employee who misses more than two (2) Act 80 / Professional Learning days during a single school year shall cease receiving any additional compensation, as set forth in in Paragraph 5 of this Agreement, for the remainder of the school year in which the absences occur, except that an employee may be excused from greater than two (2) Act 80 / Professional Learning days for extenuating circumstances. Professional development and other programming may also occur during the regular work year and regular working hours, subject to the provisions of the CBA.
4.Staff will also be given the opportunity to attend intensive professional development programming outside of the regular work year and/or regular working hours, not exceed two (2) days per month. Attendance at such programming will be optional and will be compensated at the prevailing contractual hourly rate. Whenever possible, the District shall provide staff with a minimum of two (2) weeks’ notice when such programming will occur.
5.All East staff complying with the conditions set forth above, and who maintain evaluation ratings of proficient or higher, will receive additional compensation of $3,667.00 for each year of this Agreement they are so employed. Compensation under this section, which the parties understand to be retirement-covered compensation, shall be distributed in equal parts (i.e. 26 pays) except that such additional compensation shall cease immediately in the event the employee is in violation of Paragraph 3 of this Agreement or is rated below proficient.
6.This Memorandum shall expire on June 30, 2028, unless renewed by further agreement of the parties.
7.This Agreement constitutes the entire agreement between the Parties.
8.This Agreement shall not constitute practice or precedent for the future, regardless of similarity of circumstances.
9.This Agreement is effective upon its execution.
